Terms of hire

These terms apply to every letting of the hall at Speckestraße 12, 44357 Dortmund. They are four pages shorter than most, on purpose.

§ 1 Scope and subject matter

These general terms and conditions apply to all contracts for the temporary letting of the event hall “Saal Vier” at Speckestraße 12, 44357 Dortmund, between Saal Vier Veranstaltungssaal GbR (the lessor) and the hirer.

Terms of the hirer that conflict with or deviate from these terms are not recognised unless the lessor has agreed to them in writing.

§ 2 Formation of the contract

An enquiry through this website, by telephone or by email is not binding on either side. The contract comes into existence when the lessor sends a written confirmation of hire and the hirer pays the deposit under § 4.

Dates are held free of charge and without obligation for ten calendar days after a written offer is sent.

§ 3 Hire charge

The hire charge depends solely on the date of the event and is: 1.290 € for a Saturday from May to September; 890 € for a Friday or Sunday in any month and for a Saturday in April or October; 790 € for any day from November to March and for Monday to Thursday in any month.

The charge covers use of the hall from 09:00 on the day of the event until 02:00 the following night, the 220 chairs and 26 tables, the kitchen and its appliances, the glassware, the cold room and ice machine, the public address system and house lighting, the car park, and collection of the key from 18:00 on the preceding day.

All prices include statutory value added tax at 19%. There is no service charge, no corkage, no minimum turnover and no charge per guest.

Optional extras are charged as follows: chair covers 1,50 € each; final cleaning by the lessor 120 € as a flat fee. The hire charge is payable within seven days of the event by bank transfer.

§ 4 Deposit

A deposit of 250 € is payable on formation of the contract. It secures the lessor's claims for damage, for missing inventory and for extraordinary cleaning.

The deposit is repaid to the hirer's account within five working days of the event, less any amount justifiably retained. Retentions are itemised in writing.

§ 5 Cancellation

The hirer may cancel at any time in writing. If notice is received more than 90 days before the date, the deposit is repaid in full. Between 90 and 30 days before the date, 125 € of the deposit is retained. Within 30 days of the date, the full deposit of 250 € is retained.

No further charge arises in any case, in particular no percentage of the hire charge, since the hire charge does not fall due until after the event.

If the lessor has to cancel because the hall becomes unusable through no fault of the hirer, the deposit is repaid in full and the lessor will help the hirer find a comparable hall. Further claims are excluded except in cases of intent or gross negligence.

§ 6 Use of the hall

The hirer receives the hall in a swept and ordered condition and returns it in the same condition. Decorations must be removed completely; nothing may be fixed to the parquet floor, the windows or the lantern cabling.

Open flames other than table candles in closed holders, pyrotechnics, fog machines and confetti cannons are not permitted. The maximum occupancy of 220 persons set out in the fire certificate may not be exceeded under any circumstances.

Catering may be provided by anyone the hirer chooses, including the hirer. The lessor charges no commission and maintains no list of approved suppliers.

§ 7 Noise and neighbours

Amplified music is permitted until 24:00 with the windows and terrace doors open, and until 02:00 with them closed. From 24:00 the hirer must ensure that guests leaving the building do so quietly and that the car park is not used as a meeting place.

The lessor may reduce the volume itself if the hirer does not do so after a single request. Repeated breaches entitle the lessor to end the event; in that case no part of the hire charge is refunded.

§ 8 Liability

The hirer is liable for all damage to the building, the inventory and the outside area caused by the hirer, the hirer's guests or the hirer's contractors. The lessor recommends that the hirer takes out event liability insurance.

The lessor is liable without limitation for injury to life, body and health and in cases of intent or gross negligence. In cases of slight negligence the lessor is liable only for breach of a material contractual obligation, and then only up to the foreseeable damage typical of this kind of contract.

The lessor accepts no liability for items brought into the hall, including gifts, instruments and cash boxes, unless they were expressly handed over for safekeeping.

§ 9 Final provisions

German law applies. If the hirer is a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction is Dortmund.

Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
